Disputing the Press Release of the Commissioner of Awerial County on Land Encroachment Allegations

Introduction
The Transitional Constitution of the Republic of South Sudan, 2011 (as amended), guarantees the protection of land rights, peaceful coexistence among communities, and lawful resolution of disputes. The press release dated 14 May 2026 from the Office of the Commissioner of Awerial County, Hon. Philip Mawut Garang, purporting to dismiss allegations of land encroachment between Alel Payam and Geng-Geng Payam, is hereby disputed on constitutional grounds.

Constitutional Grounds of Dispute

1. Right to Land and Property

- Article 28 of the Transitional Constitution affirms that “every person shall have the right to own property alone or in association with others” and that “the State shall protect the rights of ownership.”
- The press release dismisses community concerns without due process, thereby undermining constitutional guarantees of land ownership and protection.

2. Duty of Government to Resolve Disputes
- Article 166 mandates local government institutions to promote self-governance and peaceful resolution of disputes.
- The Commissioner’s unilateral dismissal of the allegations, without convening lawful mediation or investigation, contravenes this constitutional duty.

3. Accountability and Transparency
- Article 35 requires all public officials to act transparently and be accountable to the people.
- By labeling community concerns as “misinformation” without providing evidence or initiating lawful inquiry, the Commissioner’s office fails to uphold constitutional accountability.

4. Peaceful Coexistence and National Unity
- Article 36 emphasizes the duty of all levels of government to promote peace, unity, and reconciliation.
- The press release risks inflaming tensions by dismissing grievances outright, rather than addressing them through lawful mechanisms of dialogue and reconciliation.

Legal Position
The Transitional Constitution does not recognize arbitrary dismissal of community grievances. Any allegation of land encroachment must be addressed through lawful investigation, mediation, and adjudication under the Local Government Act, 2009, and relevant statutory provisions. The Commissioner’s press release, therefore, holds no constitutional weight and is disputed as null and void in its attempt to override constitutional protections.

Advisory to Communities
- Communities of Alel Payam and Geng-Geng Payam are urged to rely on constitutional mechanisms for dispute resolution.
- Any attempt to silence grievances outside lawful processes undermines peace and unity.
- Citizens are reminded that constitutional rights to land ownership and peaceful coexistence remain protected under national law.

SPLM caucus declares no confidence in Jemma Nunu Kumba

The SPLM Parliamentary Caucus has declared a vote of no confidence in Speaker Jemma Nunu Kumba following an internal meeting held on Tuesday.

The meeting, chaired by President Salva Kiir Mayardit, brought together SPLM members of parliament to deliberate on the administration and management of the Transitional National Legislative Assembly.

According to a statement issued by the SPLM National Secretariat, caucus members unanimously agreed to withdraw their confidence in the speaker, citing concerns over how parliamentary affairs have been handled.

The development now leaves the position of speaker uncertain, with MPs indicating they are awaiting the nomination of a new candidate by the SPLM’s top leadership.

It remains unclear whether the president will act on the caucus recommendation and formally remove Jemma from the position.
