The brakes have been put on the MotoGP circuit with an interstate legal challenge catching the South Australian Government by surprise. The South Australian Government has confirmed it is aware of an application filed in the Federal Court seeking an urgent interim injunction to stop works associated with MotoGP.
Deputy Premier Kyam Maher said in a statement that the Crown Solicitor’s Office is currently considering the application, including the orders being sought and the grounds on which they are based.
The Government intends to defend its position and will respond through the appropriate court processes,” Mr Maher said.
He added that, as the matter is now before the Court, the Government would refrain from commenting on the merits of the case while the application is being considered.
Details of the injunction have not yet been made public.
According to local reports, the application was lodged on September 18 by Joshua Hogan through the Queensland registry.
The State Government’s $96 million Adelaide Park Lands project has faced significant community opposition, particularly over the proposal of 400 hundred trees to be removed to build the racing circuit.
The Adelaide Park Lands are iconic, National Heritage Listed, recognised for their outstanding significance as part of Colonel William Light’s 1837 plan and as one of Australia’s most intact examples of 19th-century parkland and city planning.
They are also the traditional Country of the Kaurna people. The City of Adelaide acknowledges that Kaurna people managed and cared for these lands for thousands of years before colonisation and that the Park Lands contain places of cultural significance and continuing cultural connections.
These Park Lands were not created overnight. They have been shaped and cared for over generations, through decades of hard work and significant public investment. Colonel William Light’s 1837 plan deliberately surrounded Adelaide with Park Lands, creating a green belt that has become fundamental to our city’s identity as the City in a Park.
Today, those spaces provide much more than recreation. Mature trees, wetlands, grasslands and established vegetation provide crucial habitat, shelter, food and breeding areas for wildlife, while also contributing to shade, cooling and stormwater management. The Government itself has acknowledged the environmental sensitivity of the project, including the impact of tree removal and habitat loss, yet has chosen to continue with the project.
So the question before Adelaide is not simply whether replacement trees can eventually be planted elsewhere.
It is whether we should remove established habitat, mature trees and part of a nationally recognised cultural landscape to create a permanent racing track in the heart of the city for a temporary event.
For the local residents, this is not simply a temporary sporting event it means living alongside a major construction project and racing circuit in the heart of the city. Residents can face massive noise pollution from the violently loud MotoGP bike race located adjacent their homes, increase in traffic, road closures, restricted access to familiar parks and walking routes, loss of trees and green space, and disruption to everyday life. For people who live nearby, the impacts can extend beyond race days, with construction, fencing and associated works potentially affecting their neighbourhoods for many months. These are shared public spaces used every day by residents for walking, recreation, relaxation and connecting with nature, making the loss of access and amenity a very real concern for the local residents.
The Federal Court application now brings another layer of scrutiny to a project that has already generated significant community concern.
The Government has confirmed it intends to defend its position. The merits of the Federal Court case have not yet been determined, and details of the injunction application have not been made public.
