New York has enacted the country's first statewide pause on new hyperscale data centers. Governor Kathy Hochul's executive order temporarily stops state environmental permits for the largest proposed facilities while regulators develop standards addressing grid demand, utility costs, water use, noise, land disruption and community impact.

This is not a permanent ban on every data center. The executive order applies for up to one year and targets new hyperscale projects—described by the state as facilities above a high power threshold—while smaller facilities and existing operations are not covered in the same way. The pause matters because AI infrastructure is adding unusually large electricity loads to interconnection queues. New York's approach could influence other states by making developers quantify energy and water needs earlier, protect ratepayers from infrastructure costs and demonstrate clear local benefits before permits are issued.
