🌿 FEDERAL H**P UPDATE: THERE IS FINALLY SOME REAL MOVEMENT IN WASHINGTON

There has been a lot of noise surrounding the future of h**p, so here is a straightforward update on where things actually stand federally as we enter September.

First, the bad news:

The federal law passed last year is still scheduled to take effect November 12, 2026.

Among other changes, that law creates an extremely restrictive 0.4 mg total THC per-container threshold that threatens many h**p-derived products currently sold legally across the country.

Unless Congress acts, that remains the law.

But Washington is finally showing signs that Congress may act.

🇺🇸 1. The U.S. Senate just voted to delay the h**p ban.

On August 8, the Senate passed a government funding package containing a provision that would delay most of the new federal h**p restrictions until December 11, 2026, providing additional time for Congress to develop a long-term solution.

But here’s the part that deserves more attention:

Senator Ted Budd introduced an amendment specifically attempting to remove the h**p extension from the bill.

The Senate rejected that attempt:

61–32.

That means when senators were forced to vote directly on whether the h**p extension should remain in the legislation, a bipartisan majority voted to keep it. The official Senate roll call confirms the vote.

Wisconsin Senator Tammy Baldwin was among the senators voting to preserve the extension.

That doesn’t mean 61 senators support every h**p product currently on the market.

It does mean a substantial bipartisan majority was unwilling to simply allow the new federal policy to take effect without providing more time for another solution.

🏛️ 2. This is NOT law yet.

This distinction is extremely important.

The Senate acted.

The House still has to act.

Until legislation containing the extension passes both chambers and is signed by the President, businesses should continue planning around the November 12 deadline.

So if you see headlines saying:

“FEDERAL H**P BAN DELAYED!”

Pump the brakes.

The Senate voted to delay it. Congress has not completed the job.

⚠️ 3. Synthetic cannabinoids are becoming a separate battle.

There is another important detail in the Senate compromise.

The proposal protects additional time for much of the h**p industry, but does not provide the same reprieve for synthetic h**p derivatives.

Senator Amy Klobuchar’s office describes the Senate legislation very plainly: it delays the broader h**p ban through December 11 while banning synthetic h**p derivatives.

This distinction matters.

The political conversation in Washington increasingly appears to be moving away from:

“Should h**p exist?”

and toward:

“What h**p products should remain legal, and how should they be regulated?”

That’s a much different conversation.

🇺🇸 4. Even the White House is asking Congress to reconsider this.

This may be one of the most significant developments.

On June 24, the Administration formally requested that Congress revise federal h**p regulation to ensure the:

“fair treatment of h**p products”

—or, at minimum, extend implementation of the new federal framework.

That language comes directly from the White House Office of Management and Budget.

Think about what that means.

We now have:

A bipartisan group of senators fighting for additional time.

61 senators voting to preserve a h**p extension.

Multiple competing proposals in Congress for longer-term h**p regulation.

And the Administration itself asking Congress for reform or an extension.

That is considerably different from where this industry stood when the federal changes were passed last November.

🌿 5. The real fight is REGULATION vs. PROHIBITION.

This is where I believe the h**p industry needs to be very careful with its messaging.

We should not be asking Washington for another loophole.

We should be asking Washington for responsible regulation.

Age restrictions.

Testing.

Accurate labeling.

Manufacturing standards.

Reasonable potency and serving requirements.

Enforcement against companies selling unsafe or deceptively marketed products.

And meaningful authority for states that have already developed regulatory systems for h**p.

States across America have spent years building businesses, creating jobs, collecting tax revenue and developing their own regulatory frameworks around an industry that the federal government legalized in 2018.

Destroying those regulated markets with an arbitrary federal threshold is not responsible regulation.

Regulate h**p. Don’t eradicate it.

🧀 And this matters tremendously for Wisconsin.

Wisconsin’s h**p industry is not some theoretical future industry.

It exists right now.

Wisconsin businesses employ people, occupy storefronts and manufacturing facilities, pay taxes and invest millions of dollars into compliance.

Our state has also moved toward substantially greater oversight of h**p products.

That’s exactly why Wisconsin should have a seat at the table as Congress determines what comes next.

The argument should not be:

“Leave h**p alone.”

The better argument is:

“Give responsible businesses clear rules and let us follow them.”

There absolutely are problems in the h**p industry that deserve to be addressed.

But prohibition is not the same thing as regulation.

THE BOTTOM LINE:

🌿 November 12 remains the federal deadline today.

🏛️ The Senate has voted for additional time.

🗳️ An attempt to remove that protection failed 61–32.

🇺🇸 The White House has asked Congress for h**p reform or an extension.

⚠️ Synthetic cannabinoids face a substantially more difficult political future.

📜 Congress is now considering multiple approaches to what a permanent regulated h**p market could look like.

And most importantly:

H**p is not saved.

But for the first time in quite a while, there is a credible path toward replacing an unworkable federal prohibition with something better.

The next several weeks in Washington matter enormously.

For everyone who farms h**p, manufactures h**p products, owns a h**p business, works in one, or simply believes adults should have access to responsibly regulated h**p products:

Stay engaged.

This fight is far from over.
